Is Senator Rochas Okorocha a thief ?

A thief is defined by the English Dictionary as a swindler, peculator, embezzler, defrauder, etc. or a criminal who takes property belonging to someone else, with the intention of keeping it or selling it.

The Criminal Code Act, CAP 77, Laws of the Federation, 1990, Section 383, defines a thief or someone who steals as a person who fraudulently takes anything capable of being stolen, or fraudulently converts to his own use or to the use of any other person, anything capable of being stolen, is said to steal that thing.
Section 383 (2) states that :

A person who takes or converts anything capable of being stolen is deemed to do so fraudulently if he does so with any of the following intent:
(f) in the case of money,an intent to use it at the will of the person who takes or converts it, although he may intend afterwards to repay the amount to the owner.

Section 383(6) states that, A person shall not be deemed to take a thing unless he moves the thing or causes it to move.

EFCC, Port harcourt zonal Head, Usman Imam, while peaking at the commission’s zonal office in Port Harcourt, Rivers on Thursday, stated that N7.9bn belonging to Imo State was seized from the former governor, Senator Rochas Okorocha, during EFCC investigations.

He said: “I started the Imo state case in Enugu and upon my deployment to this zone, the investigations of corruption allegations against the former Governor of Imo State, Rochas Okorocha, was transfered from the Enugu zone to Port Harcourt for further investigations.

“Within the period, the commission succeeded in freezing about N7.9bn in different accounts. All the monies that were released to Imo State government were from the N7.9bn recovered from Okorocha. The monies were released in batches.

That Senator Rochas Okorocha has not taken any action against EFCC over the freezing of the accounts where those monies were found and the seizure of over 7 billion naira,attest to the fact that Senator Rochas Okorocha fraudulently appropriated those funds.

Okorocha should therefore be prosecuted and not be allowed to be flaunting his illegally acquired wealth

Senator Rochas Okorocha is the former governor of Imo State and Senator representing Imo West Senatorial District at the National Assembly.
